Last updated: August 1, 2025

Read in: ENGLISH

Effective Date: August 1, 2025.

This Privacy Policy explains how Vositone Technologies ("we," "our," or "us") collects, uses, shares, and protects your personal information when you use our products, services, and website. We are committed to transparency and protecting your privacy in accordance with global data protection laws, including the EU General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and China's Personal Information Protection Law (PIPL)[vositone.com]. By using Vositone's products or services, you consent to the practices described in this policy.

1. Data Collected and How We Collect It

We collect personal data from you directly when you provide it, and automatically through your use of our devices and services. Below are the categories of personal data we may collect:

• Account and Profile Information: When you create an account or profile with us, you provide certain personal information such as your name, email address, phone number, date of birth, gender, and password[vositone.com]. We may also collect additional profile data like your height, weight, and other health or fitness metrics if you choose to enter them (for example, to enable personalized health insights)[vositone.com]. This information is collected directly from you via registration forms or profile settings in our mobile apps or website.
• Device and Usage Data: We automatically collect information about your device and how you use our services. This includes your device type and unique identifiers (such as the device’s IMEI or serial number), operating system, and mobile network information[vositone.com]. We also log technical data like your IP address, browser type, and usage details (for example, when you access our app, how long you use it, and which features you interact with)[vositone.com]. This data is collected through our servers and mobile SDKs as part of the normal operation of our services.
• Health and Activity Data: If you use our wearable devices or health-tracking services, we collect data about your health, fitness, and daily activities. This may include your heart rate, sleep patterns, exercise routines, steps taken, calories burned, and other biometric or wellness data[vositone.com]. For example, our AI Sleep Watch and Eco IoT Tracker collect detailed sleep metrics and environmental data to provide medical-grade sleep analysis and eco-friendly insights[vositone.com]. This data is collected via the sensors in our devices and synchronized to our servers when your device connects to the internet.
• Location Data: Our products may collect location information. For instance, if you use GPS features on our devices or share your location for fitness tracking or geofencing, we may collect your precise location data (such as through GPS coordinates or Wi-Fi positioning)[vositone.com]. We only collect location data if you enable location services on your device and consent to its use for the relevant features. You can disable location collection at any time through your device or app settings.
• Communications and Content: If you contact us for support or participate in our forums or community, we collect the information you include in those communications (for example, your email address and the content of your message)[vositone.com]. We may also collect information about your interactions with our customer support, including call recordings or chat logs, to help resolve your inquiries and improve our service. Additionally, if you use any social sharing or messaging features in our services, we collect the information you choose to share with others (such as workout results or health metrics you post to a shared group).
• Other Information: We may collect other data as described elsewhere in this policy or at the time of collection. For example, when you participate in surveys or promotions, we collect the information you provide there. We also use cookies and similar tracking technologies on our website and apps to collect usage data and to personalize your experience (see Section 6 for more details on cookies)[vositone.com]. The cookies we use may include session cookies (temporary cookies that expire when you close your browser) and persistent cookies that remain on your device to remember your preferences[vositone.com]. We use these technologies to analyze trends, administer the site, track user movements, and gather demographic information[vositone.com]. If you prefer not to have cookies stored, you can adjust your browser settings accordingly (though this may impact your ability to use certain features of our site).

Note: We do not intentionally collect personal information from children under the age of 13 (or under 16 in the EU, where applicable) without parental consent. Our services are not directed at children in this age group. If we discover that we have inadvertently collected personal data from a child under this age without proper consent, we will take steps to delete that information as soon as possible [privacy.commonsense.org].

2. How We Use Your Personal Data

We use the information we collect for a variety of purposes related to providing and improving our products and services, communicating with you, and personalizing your experience. Specifically, we use your personal data for the following purposes:

• Providing and Maintaining Services: We use your data to deliver the Vositone products and services you requested. This includes operating our wearable devices and companion apps, processing your account registration, and enabling features like health tracking, sleep analysis, and eco-tracking. For example, we use your health and activity data to generate insights and recommendations (such as sleep quality reports or fitness tips) and to sync your data across devices[vositone.com]. We also use your information to maintain your account, process any purchases or transactions (if applicable), and provide customer support. In short, we use your data to fulfill the core functionality of our products and ensure you can use them as intended.
• Personalization and Improvement: We may use your personal data to personalize your experience with our products. This includes customizing the content or recommendations you receive (for instance, tailoring health tips to your goals or preferences) and providing a more relevant user interface. We also analyze usage data and aggregated health data to improve our products and services. By understanding how users interact with our devices and what health trends they exhibit, we can enhance the accuracy of our algorithms and the features we offer. All such analysis is done in aggregate or anonymized form to protect individual privacy[vositone.com].
• Communication: We use your contact information (such as email or phone number) to communicate with you about our services. This can include sending you service-related announcements, updates to our terms or policies, or technical notices. We may also send you marketing communications about new products, promotions, or special offers if you have opted in to receive such information. If you no longer wish to receive marketing emails, you can unsubscribe by following the link in any promotional email or by updating your communication preferences in your account settings. We will never use sensitive health data to target advertising without your explicit consent, and we do not sell your personal data to third parties for marketing purposes.
• Security and Fraud Prevention: We use your data to help keep our services and other users safe. This includes verifying your identity, detecting and preventing fraudulent or unauthorized activity, and enforcing our Terms of Service. For example, we may use your login history and device information to identify suspicious login attempts and protect your account. We also use your data to ensure compliance with legal obligations and to respond to lawful requests (such as government subpoenas or court orders), as described further in Section 5.
• Research and Development: From time to time, we may use aggregated or de-identified data for research and development purposes to create new features or improve existing ones. This could involve analyzing trends in sleep patterns or environmental data across our user base to develop better health insights. Any such research uses data in a form that does not identify individual users.

For each of these purposes, we will ensure that we have a valid legal basis for processing your personal data as required by applicable law. For example, under the GDPR, we may process your data based on your consent (if you have agreed to specific uses), because it is necessary to perform a contract with you (such as providing the services you signed up for), or because we have a legitimate interest in operating and improving our services (as long as those interests are not overridden by your privacy rights)[itgovernance.eu]. We will obtain your explicit consent for any processing of sensitive personal data (such as health data) as required by law.

3. Data Sharing and Disclosure

We do not sell your personal information to third parties. We may share your data only in the limited circumstances described below, and we will take steps to ensure that your data remains protected when it is shared:

• Service Providers and Contractors: We may share your personal data with trusted third-party service providers who assist us in operating our business and services. These include companies that help with data hosting and cloud services, customer support, marketing, and analytics. For example, we may use a cloud storage provider to host your health data or a shipping company to deliver devices to you. When we share your data with these service providers, we do so under confidentiality agreements or contracts that require them to protect your data and use it only for the purposes we specify[vositone.com]. We do not authorize these third parties to use your personal data for any other purpose or to disclose it to others.
• Business Partners: In some cases, we may share data with business partners for specific, limited purposes. For instance, if you participate in a wellness program or research study in partnership with a third party, we may share the relevant data with that partner to fulfill the program’s goals (with your consent, if required). We will ensure that any such partner has appropriate privacy protections in place. We will not share sensitive health data with partners for marketing purposes without your consent.
• Affiliated Companies: We may share data within our corporate group or with our parent, subsidiaries, or other affiliated companies. This could be to provide integrated services or to maintain consistent accounts across our family of products. For example, if we have related apps or services, we might share data to allow you to use them together. Our affiliates will handle your data in accordance with this Privacy Policy and any additional privacy commitments we make.
• User-Initiated Sharing: You may have the option to share your data with others through our services. For example, you might choose to share your workout results with a friend or connect your Vositone account to a social media platform. When you do so, the information you explicitly share (such as your name, activity stats, or messages) will be disclosed to the intended recipients. We encourage you to be mindful of what information you share publicly. Any data you share via social features is governed by the privacy settings you choose and the terms of those third-party platforms.
• Legal and Safety Disclosures: We may disclose your personal data if required to do so by law or in response to a valid legal request (such as a court order, subpoena, or government inquiry)[vositone.com]. We will also share information if we believe it is necessary to protect the rights, property, or safety of Vositone, our users, or the public[vositone.com]. This includes situations such as detecting or preventing fraud, harm, or illegal activities, or complying with national security or law enforcement requirements. If we are legally compelled to disclose your data, we will attempt to notify you unless prohibited by law or if doing so would be futile or dangerous.
• Business Transfers: In the event of a merger, acquisition, reorganization, or sale of all or a portion of our business assets, your personal data may be transferred as part of that transaction. We will ensure that any such successor or acquirer honors this Privacy Policy and the commitments we have made regarding your data, or we will obtain your consent for any new use of your data in such circumstances.

Transfers of Data to Other Countries: Vositone is a global company, and your personal data may be processed or stored in countries other than the one in which you reside. For instance, our servers may be located in the United States or China, and our service providers may be in various countries. We will ensure that any transfer of your personal data outside of your home country complies with applicable data protection laws. Under the GDPR, we will use appropriate safeguards for transfers to countries outside the EU/EEA, such as standard contractual clauses approved by the European Commission or binding corporate rules[cdp.cooley.com]. Under PIPL, we will follow the required procedures for cross-border data transfers (which may include obtaining consent, conducting security assessments, or using government-approved standard contracts). We will provide you with information about any international transfers of your data and the safeguards in place upon request.

4. Your Rights and Choices

We respect your rights over your personal data. Depending on where you live, you may have certain legal rights to access, correct, or delete your information, and to restrict or object to how we process it. Below is a summary of your key rights and how you can exercise them:

• Access and Data Portability: You have the right to request access to the personal data we hold about you. This includes the right to obtain a copy of your data and information about how we process it. You may also have the right to obtain your data in a structured, commonly used format and to have it transferred to another data controller (data portability), where applicable. To exercise these rights, please contact our Data Protection team at privacy@vositone.com. We will respond to your request in accordance with legal requirements (typically within one month under GDPR).
• Correction: If any of your personal data that we hold is inaccurate or incomplete, you have the right to request that we correct or update it. You can often update your profile information directly through your account settings in our app or website. If you need further assistance in correcting other data, please contact us and we will make the necessary changes.
• Deletion (Right to Be Forgotten): Under certain circumstances, you may have the right to request that we delete your personal data. This is sometimes known as the “right to be forgotten.” We will consider such requests and delete your data if there is no compelling legal reason to keep it (for example, if we no longer need the data for our services and you withdraw consent, or if we are legally required to delete it). If we delete your data, we will also inform any third parties who received that data from us to delete it as well (unless this is impossible or involves disproportionate effort). Please note that there are exceptions – for instance, we may need to retain some data for legal or legitimate business reasons (such as to comply with tax records or to resolve disputes). We will notify you if we cannot fully comply with a deletion request and explain the reasons.
• Restriction of Processing: You may request that we restrict or limit how we process your personal data in certain situations. For example, if you contest the accuracy of your data, you can ask us to restrict processing until we verify its accuracy. If we agree to your request, we will only process that data with your consent or for legal reasons, not for our normal purposes.
• Objection: You have the right to object to our processing of your personal data in certain circumstances. This includes objecting to processing based on our legitimate interests or for direct marketing purposes. If you object to direct marketing, we will stop sending you promotional communications. If you object to processing for other reasons (for example, if you feel it infringes on your privacy), we will review the request and, unless we have compelling legitimate grounds to continue processing or it is needed for legal reasons, we will cease processing your data.
• Withdrawal of Consent: Where processing is based on your consent, you have the right to withdraw that consent at any time. Withdrawing consent will not affect the lawfulness of processing done before you withdrew consent. If you withdraw consent, we may no longer be able to provide certain services to you (for example, if you withdraw consent to collect health data, we may not be able to provide health tracking features). We will inform you of any such consequences when you withdraw consent.
• Complaints: If you believe that your privacy rights have been violated or if you are not satisfied with how we handle your data, you have the right to lodge a complaint with a data protection supervisory authority in your jurisdiction. For EU residents, this is typically the data protection authority of the country where you live or work. For California residents, you may contact the California Attorney General. We encourage you to contact us first with any concerns, as we will work to resolve issues directly, but exercising your right to file a complaint with a regulator is always available to you.

To exercise any of these rights or to ask questions about your data, please contact our Privacy team. We may ask you to verify your identity before fulfilling a request to ensure that your personal data is not disclosed to the wrong person. We will handle all such requests in accordance with the timelines and requirements set by applicable law (for example, within 30 days for GDPR and CCPA requests).

California Privacy Rights: California residents have additional rights under the CCPA. Specifically, you have the right to know what personal information we collect about you and to whom it is disclosed, the right to request deletion of your personal information, and the right to opt-out of the “sale” of your personal information. We do not sell personal data as defined by CCPA, but if we did, we would provide a clear opt-out mechanism on our website. If you are a California resident, you may submit a request to know or delete your data by contacting us as indicated above. We will not discriminate against you for exercising these rights (for example, we will not deny you service or charge you different prices).

Children's Privacy: As noted, we do not knowingly collect personal data from children under 13. If you are a parent or guardian and believe that a child under 13 has provided us with personal data, please contact us, and we will promptly delete that information[privacy.commonsense.org].

5. Data Security

We take the security of your personal data very seriously. We implement a variety of technical, administrative, and physical safeguards to protect your information from unauthorized access, loss, misuse, or alteration. Some of the security measures we employ include:

• Encryption: We use encryption technologies (such as SSL/TLS) to protect the transmission of data between your device and our servers[safety.google]. Sensitive data stored on our servers is also encrypted or otherwise secured. For example, passwords are stored in hashed form and cannot be retrieved in plain text. We regularly review our encryption standards to ensure they meet or exceed industry best practices.
• Access Controls: We restrict access to personal data to those employees and contractors who need it to perform their job functions. Access is granted on a need-to-know basis and is protected by strong authentication (e.g., passwords, two-factor authentication for internal systems). We also maintain internal policies to prevent misuse of data and regularly train our staff on privacy and security procedures.
• Data Minimization and Retention: We adhere to the principle of data minimization – meaning we collect only the data necessary for our legitimate purposes and do not keep it longer than needed. We have retention policies that specify how long we keep personal data based on its type and use. Generally, we will retain your data for as long as your account is active or as needed to provide you services, and for a limited period thereafter to fulfill legal obligations or resolve disputes. After that, we securely delete or anonymize the data. For example, if you delete your account, we will delete your personal data from our active systems (subject to any legal retention requirements).
• Security Monitoring and Incident Response: We continuously monitor our systems for potential security incidents and have an incident response plan in place. In the unlikely event of a data breach that could harm user privacy, we will promptly investigate and, if required by law, notify affected users and the appropriate authorities within the mandated timeframe (for example, within 72 hours for GDPR reportable breaches)[itgovernance.eu]. We will also take steps to mitigate any damage caused by the breach and improve our security measures to prevent recurrence.
• Third-Party Security: We require that any third-party service providers who handle your data implement appropriate security measures as well. We enter into contracts that obligate them to protect data confidentiality and security, and we may conduct due diligence on their practices. For instance, if we use a cloud provider, they must meet our security standards (which often align with industry certifications like ISO 27001 or SOC 2).

While we strive to protect your personal data, no method of transmission or storage over the internet is 100% secure. We cannot guarantee absolute security, but we will make every effort to safeguard your information. You can also help protect your data by using strong passwords for your account and not sharing your login credentials with others. If you suspect any security issue with your account, please contact us immediately.

6. Cookies and Tracking Technologies

Our website and mobile applications may use cookies and other tracking technologies to enhance your experience and analyze usage. Here’s what you need to know about these technologies:

• What Are Cookies: A cookie is a small text file that is stored on your device (computer, smartphone, or tablet) when you visit a website or use an app. Cookies can be session cookies (which expire when you close your browser) or persistent cookies (which stay on your device for a set period or until you delete them)[vositone.com]. We use cookies to keep you logged in, remember your preferences, and analyze how our site is used.
• Types of Cookies We Use: We use a combination of session and persistent cookies for various purposes, including:
  • Authentication and Session Management: To keep you logged into your account while you navigate our site or app.
  • Analytics: To collect information about how users access and use our website (for example, which pages are visited most, how long users stay, etc.). This helps us improve our site and services. We may use third-party analytics services (like Google Analytics) which also use cookies or similar tracking.
  • Personalization: To remember your preferences (such as language or region settings) so we can provide a more tailored experience.
  • Advertising and Marketing: We may use cookies to deliver targeted advertising that is relevant to your interests. For example, if you’ve shown interest in a particular product, we might use cookies to show you related ads. We and our partners may use tracking pixels or beacons in emails or on web pages to count visits or understand if you interact with our communications.
• Third-Party Cookies: In addition to our own cookies, third parties (such as analytics providers, social media platforms, or ad networks) may place cookies on your device through our site. These third parties may collect information about your online activities over time and across different websites when you use our services. For instance, a social media “Like” button on our site might set a cookie to enable that feature. We have no direct control over these third-party cookies; their use is governed by the third parties’ own privacy policies.
• Managing Cookies: You can control and manage cookies in various ways. Most web browsers allow you to block or delete cookies. You can usually find these settings in your browser’s options or preferences menu. If you choose to block cookies, some features of our site may not function properly or you may be asked to log in more frequently. You can also use browser tools to delete cookies that have already been stored on your device. Additionally, many browsers now offer a “Do Not Track” feature that signals to websites that you do not want to be tracked. We respect Do Not Track signals in accordance with industry standards – for example, if your browser is set to Do Not Track, we will disable our analytics tracking cookies.
• Other Tracking Technologies: Besides cookies, we and our partners may use other technologies like web beacons (also known as pixel tags or clear GIFs), which are tiny images embedded in web pages or emails that can monitor your viewing or interaction. Web beacons can help us count visitors to a page or track if an email was opened. We also may use device fingerprinting to recognize your device for security or personalization purposes. These technologies may collect information such as your IP address, browser type, and device identifiers. We use them in ways consistent with this Privacy Policy and will not use them to identify you personally without your consent except as described.

By continuing to use our services, you consent to our use of cookies and tracking technologies as described. If you have questions about how we use cookies or how to disable them, please contact us.

7. Policy Updates and Contact Information

We may update this Privacy Policy from time to time to reflect changes in our products, services, or legal requirements. We will notify you of any material changes by posting the updated policy on our website with a new effective date. In some cases, we may also send you an email or in-app notification about the changes. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your data. Your continued use of our services after the effective date of a revised policy constitutes your acceptance of those changes.
